The website www.walkintothewild.in (“Website” or “Platform”) is owned, controlled, and managed by Mediarc Technologies Private Limited (“Company” or “Walkintothewild” or “we” or “us” or “our” or “ours”), which operates as an e-commerce operator and manages the Platform as a dedicated online marketplace for wildlife travel. The Platform enables travel agents and service providers to list and promote safari tours, travel packages, and related hospitality offerings, connect with prospective travellers seeking wildlife experiences, and enhance their visibility and customer outreach in the global wildlife tourism segment (“Services”).

Please review our Terms of Use and Privacy Policy available on the Platform (collectively referred to as the “Terms of Use”) that govern Your (“User” or “you” or “your”) use of Our Platform and Services. You also acknowledge that the information you provided, in any manner whatsoever, is not confidential or proprietary and does not infringe any right of third party in whatsoever nature.

In the event that the person refuses to be bound as the principal of these Terms of Use, you agree to accept liability of any harm caused by any wrongful use of the Platform resulting from such access or use of the Platform in whatsoever nature.

If we have found a breach or suspected breach of the security of your account, we may require you to change your password, temporarily or permanently block or suspended your account without any liability to Walkintothewild.

We reserve the right to refuse service and/or terminate accounts without prior notice if these Terms of Use are violated or if we decide, at our sole discretion, that it would be in Walkintothewild’s best interest to do so. You are solely responsible for all consents that you uploaded, post, email, images, blogs or otherwise transmit via the Platform. USER CONTENT

You retain ownership and sole responsible for any text, message, chat communication, billboard postings, software, photos, drawings, graphics, profile, opinions, ideas, images, videos, audio files or other material or information posted, uploaded, emailed, transmitted or otherwise made available to the platform by your (collectively “User Content”). Therefore, you are responsible for User Content, and you must ensure that you have all rights and permission needed to User Content on the Platform.

By using the Platform, you grant us a worldwide, perpetual, unrestricted, royalty free license to use, reproduce, distribute, modify, adapt, create derivative works, make publicly available, and otherwise exploit User Content, but only for the limited purpose of providing the Services to you and as otherwise permitted by our Privacy Policies. Walkintothewild does not endorse or control the User Content transmitted or posted on the platform and therefore, accuracy, integrity or quality of User Content is not guaranteed by Walkintothewild. You understand that by using the Platform, you may be exposed to User Content that is offensive, indecent or objectionable to you. Under no circumstances will Walkintothewild be liable in any manner whatsoever for any User Content, including without limitation, for any errors or omissions in any User Content, or for any loss or damage of kind incurred by you as a result of the use of any User Content. You hereby waive all rights to any claims against Walkintothewild for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with User Content.

You hereby acknowledge that Walkintothewild has the right, but not the obligation, at its sole discretion to refuse to post or to remove any User Content and further reserves the right to change, condense, or delete any User Content.

To the extent that You provide any User Content, You represent and warrant that: 

You have all necessary rights, licenses and/or clearances to provide such User Content and permit Company to use such User Content as provided above; 

such User Content is accurate and reasonably complete;

as between you and the Company, you shall be solely responsible for the payment of any third-party fees arising from the provision or use of such User Content; and

such User Content does not and will not infringe or misappropriate any third-party rights, nor will it constitute a fraudulent statement, misrepresentation, or unfair business practice.

Other users may share, use, or repost publicly visible content you upload, in accordance with platform functionality and these Terms.

By uploading or posting content publicly on the Platform (including images, text, or videos), you grant Walk Into The Wild a non-exclusive, royalty-free, perpetual license to use such content in promotional material, website features, social media channels, or marketing campaigns. We will always aim to give credit where feasible.

The Platform may enable you to interact with other users, including via shared safaris, comments, and messaging. However, Walk Into The Wild does not take responsibility for any arrangements, coordination, disputes, or outcomes resulting from user-to-user interaction, whether online or offline. Users are advised to exercise discretion and caution during such interactions.

REPRESENTATIONS AND WARRANTIES 

Your use of our Platform is based on the representation that the information shared by you is true, accurate and complete in all respects. 

Company makes no representations or warranties of any kind, whether expressed or implied, with respect to Services available on or through this Platform, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Company makes no warranty that the services will meet the User's requirements or that the services will be uninterrupted, timely, secure, or error free; nor does Company make any warranty as to the results that may be obtained from the use of the services, or as to the accuracy or reliability of any information obtained through the services, or that any defects in the software will be corrected. 

TERMINATION

You agree that Walkintothewild, at its sole discretion, for any or no reason, and without penalty or notice, may suspend or terminate your account (or any part thereof) or your use of the Platform at any time, if Company believes that You have:  

breached the Terms of Use;  

infringed the Third-Party IP;  

posted, uploaded, or transmitted unauthorized content on the Platform; or  

violated or acted inconsistently with the letter or spirit of these Terms of Use.  

You also acknowledge that Walkintothewild may retain and store Your information on Company’s systems notwithstanding termination of Your access.

You agree that any termination of your access to the Platform or any account you may have, or portion thereof may be without prior notice, and you agree that Walkintothewild will not be liable to you or any third party for such termination. 

Any suspected fraudulent, abusive or illegal activity may be referred to an appropriate law enforcement authority. These remedies are in addition to any other remedies that Walkintothewild may have at law or in equity.

Upon termination for any reason of the Terms of Use by either you or Walkintothewild, you must promptly destroy all materials downloaded or otherwise obtained from this Platform, as well as all copies of such materials, whether made under the Terms of Use or otherwise. 

DISCLAIMER OR WARRANTY AND LIMITED LIABILITY

You acknowledge and undertake that you are accessing the Services on the Platform and transacting at your own risk and are using your best and prudent judgement before entering into any transactions through the Website. We hereby expressly disclaim any and all responsibility and liability in this regard. 

The Platform is presented “as is” and “as available” basis without any warranty or condition, express, implied or statutory. You agree that in no event will Walkintothewild or its affiliates, directors, employees, agents, licensors, partners, suppliers be liable to you for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages (including without limitation lost business opportunities, lost revenue, or loss of anticipated profits or any other pecuniary or non-pecuniary loss or damage of any nature whatsoever) arising out of or relating to:

(i) these Terms;

(ii) the Platform; or

(iii) your use or inability to use the Platform.

In no event will Walkintothewild or any of its contractors, directors, employees, agents, third party partners, licensors or suppliers be liable to you for any losses, damages, liabilities, and causes of acting arising out of any act, omission or negligence to which you contributed.

Walkintothewild does not warrant that access to, or use of the Platform will be uninterrupted, timely, secure, or error-free, nor does it warrant that any results obtained from the use of the Platform will be accurate or reliable.

You agree that any deactivation or termination of your access and account to the Platform may be affected without prior notice to you and that Company shall not be liable to you nor any third party for any termination of your access to the Platform.

There might be trademarks, logos and brand names of other companies on the website (“Third Party IP”). Use of these names, trademarks and brands or Third-Party IP does not imply endorsement. These are the property of their respective trademark holders. 

You may not use any of these Third-Party IP, or any variations thereof, without the owner’s prior written consent. Nothing contained on the Platform should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Third-Party IP displayed on the Platform without the written permission of the owner of the applicable Third-Party IP.

INDEMNIFICATION

You agree to defend indemnify and hold Walkintothewild and its affiliates, contractors, employees, officers, directors, agents and third party partner harmless form any and all claims, losses, damages, liabilities, costs and expenses, including without limitation, legal fees and expenses, caused or arising out of claims based upon your actions or inactions or related to your use or misuses of the Platform, any violation of these Terms of Use or any of the covenants made by you herein, which may result in any loss or liability to Walkintothewild or any third party and information or content that you post or otherwise make available on the Platform, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights. 

INTELLECTUAL PROPERTY RIGHTS

All material and Content on the Platform, including images, illustration, text, graphics, logos, button icons, images, audio clips, digital downloads, data complications and software, is our property, or the property of our affiliates or content suppliers, and is protected by Indian and International Property law, including copyrights, author’s rights database rights law, trademark and other intellectual property rights that are owned and controlled by us or by other parties that have licensed their material to us. The complication of all Content on Platform is our exclusive property and is protected by law of India and International copyright and database right laws. All software used on Platform is also our exclusive property, or the property of our affiliates or software suppliers, and is protected by Indian and International copyright, author’s rights law and other intellectual property rights. You hereby agree to not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by e-mail or other electronic means whether directly or indirectly and you must not assist any other person to do so. Without the prior consent of the owner, modification of the materials, use of the materials on any other website or use of the materials for any other purpose other than personal, non-commercial use is a violation of copyrights, trademarks and other proprietary rights, and is prohibited.

Governing Law and Jurisdiction: The Terms of Use shall be governed in accordance with the laws of India and any disputes arising out of or in connection with the Terms of Use shall be subject to exclusive jurisdiction of courts in New Delhi, India.

Modification: We may modify these terms or any additional terms that apply to these Services to, for example, reflect changes to the law or changes to our Services. No Class Actions: You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.

The Platform strictly prohibits fake, defamatory, misleading, or abusive content, including content that is discriminatory, unlawful, based on secondhand information, or intended to manipulate public perception. By submitting a contribution, you confirm it is genuine and grant Walkintothewild a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content. Walkintothewild assumes no liability for user-generated content and retains full editorial control over all contributions.

Severability: If a particular term is not enforceable, the unenforceability of that term will not affect any other terms. 

Waiver: The failure of Company to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. No waiver shall be binding unless executed in writing by the party making the waiver.
